POMPOM Women’s Yoga is a trading name of Eleanor Flight, who trades as a sole trader and is the data controller responsible for your personal information.

This privacy policy sets out how POMPOM Women’s Yoga uses and protects any information that you give us when you use this website, book a class, or complete our registration form and Health Questionnaire. We collect basic information such as your name and contact details, as well as some medical history relevant to practising Yoga.

Most of your information will have been provided by you using Bookwhen’s booking system and by completing our Health Questionnaire.

What we collect

We may collect the following information:

  • name
  • contact information including email address and telephone number
  • demographic information such as postcode, preferences and interests
  • health information relevant to practising Yoga, which may include pregnancy and postnatal history, pelvic health, and menopause-related symptoms
  • the name and contact details of an emergency contact you nominate
  • your name, email address and (if you choose to give it) telephone number, if you join the waiting list for a class
  • other information relevant to customer surveys and/or offers

Health information

Some of what we collect — your medical history, pregnancy or postnatal details, pelvic health and any menopause-related symptoms — is known as “special category data” under UK GDPR. This means the law gives it extra protection, and we treat it accordingly.

We collect and use this information only with your explicit consent, which you give when you complete the Health Questionnaire. We use it for one purpose: to keep you safe in class, adapt exercises to your body, and meet our duty of care as your teacher.

You can withdraw your consent at any time by contacting us. If you do, we will delete your health information, although this may mean we are no longer able to teach you safely.

What we do with the information we gather

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • To provide and manage the classes you have booked. Our lawful basis is performance of our contract with you.
  • To keep track of medical conditions that are important to your Yoga practice, so that classes can be adapted safely. This information can be viewed by our Yoga Teacher, who must abide by our terms and conditions and data protection laws. Our lawful basis is your explicit consent.
  • To let you know when a class you have joined the waiting list for becomes available. Our lawful basis is taking steps at your request before entering into a contract. Joining a waiting list does not add you to our mailing list.
  • Internal record keeping, accounts and tax. Our lawful basis is our legal obligations and our legitimate interest in running the business properly.
  • To improve our classes and services. Our lawful basis is our legitimate interest in developing what we offer.
  • To send occasional emails about news, offers or other information we think you may find interesting. Our lawful basis is your consent, and you can unsubscribe at any time.

Who we share it with

We never sell your information, and we do not pass it to anyone for their own marketing. We do use a small number of service providers to run the business, who process information on our instructions only:

  • Bookwhen — class bookings and payments
  • MailerLite — our mailing list
  • Plausible and PostHog — website analytics
  • Our website hosting and email providers

If you become unwell or are injured during a class, we may share relevant information with the emergency contact you have given us, and with emergency services or medical professionals treating you. Where you are unable to give consent at the time, our lawful basis for doing so is your vital interests.

We may also share information where we are required to do so by law.

Cookies and website analytics

We use Plausible and PostHog to understand how visitors use this website, so that we can improve it. When you first visit, you can choose whether to accept non-essential analytics cookies. Declining will not affect your ability to use the site or book a class, and you can change your mind at any time.

Security

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

How long do we hold your records?

We manage our records to help us serve our customers well, for example dealing with any queries relating to your account, and to comply with legal and regulatory requirements. Records help us demonstrate we are meeting our responsibilities and serve as evidence of our business activities.

In general:

  • booking and financial records are kept for six years from the end of the tax year they relate to, as required for tax purposes
  • Health Questionnaires and emergency contact details are kept for three years after your most recent class, in case of any query or claim. If you return to classes after that time, we will simply ask you to complete a new Health Questionnaire
  • waiting list details are kept until the class you asked about has run, or until you tell us you are no longer interested
  • if you unsubscribe from our mailing list, we stop emailing you straight away. Our email provider keeps your record marked as “unsubscribed” so that you are not added back or contacted again by mistake. If you would prefer your details to be removed altogether, just ask and we will delete them

Retention periods may be changed from time to time based on business, legal or regulatory requirements.

Your rights

You have a number of legal rights to control what we do with your information. You can ask us:

  • to tell you what information we hold about you, and for a copy of it
  • to correct or update information that is wrong or out of date
  • to delete your information
  • to restrict or stop how we use it
  • to provide your information in a portable format
  • to withdraw your consent at any time, including unsubscribing from marketing emails

To exercise any of these rights, please contact us using the details below. We will respond within one month.

Complaints

If you are unhappy with how we have handled your information, please contact us first so that we can put it right. You also have the right to complain to the Information Commissioner’s Office (ICO), the UK regulator for data protection, at ico.org.uk or on 0303 123 1113.
