Terms and Conditions
POMPOM Women’s Yoga is a trading name of Eleanor Flight, who trades as a sole trader. These Terms and Conditions form an agreement between the Attendee and Eleanor Flight trading as POMPOM Women’s Yoga.
These Terms and Conditions are incorporated into the Registration Form and any Attendee is subject to these Terms and Conditions.
POMPOM Women’s Yoga reserves the right to vary and revoke these Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of the internal affairs of the Studios and/or the conduct of Attendees. Any such changes will be published on the Website and, until revoked, are binding on Attendees.
Attendance
- When a person has signed up to a class they shall become an Attendee of POMPOM Women’s Yoga subject to these Terms and Conditions.
- Acceptance of a person as an Attendee is in the absolute discretion of POMPOM Women’s Yoga and we reserve the right to refuse an Attendee.
- A person shall cease to be an Attendee when all sessions they have paid for or booked onto have expired.
- POMPOM Women’s Yoga reserves the right to expel from the Studios, suspend for a specific period or terminate the attendance of any Attendee whose conduct is or may be, in POMPOM Women’s Yoga’s reasonable opinion, damaging to the character of the Studios or amounts to a breach of these Terms and Conditions or where such expulsion is otherwise in the interests of the other Attendees. Any Attendee so expelled or that has their attendance terminated or suspended shall forfeit all privileges to attendance of the Studios and shall not be entitled to any refund.
- Details of prices of classes are available on the Bookwhen booking page and shall be such prices as determined by POMPOM Women’s Yoga.
- Subject to any statutory right of cancellation, payments for classes are non-refundable unless otherwise stated in these Terms and Conditions.
Gift Vouchers
- Gift vouchers may be redeemed against the number of classes which are stated on the gift voucher. Gift voucher places may only be redeemed for classes which are not already full.
- If a class has been paid for by gift voucher and is then cancelled, a refund will be issued to the gift voucher or a new voucher issued.
- Gift vouchers are non-refundable.
Cancellation
- Full payment for all classes is required prior to participation in the class.
- Please note full payment for all workshops and classes is required on booking and is not refundable. You may transfer your booking to another person provided that you inform us about the change in writing.
- Please note that private class cancellations require 24-hour notice or full fee will be due.
Refunds and Transfers
- Refunds will be given in the instance that POMPOM cancels a class. The amount refunded will be equal to the amount paid for the class. If the class is part of a bulk purchase of more than one ticket at a reduced rate, the amount returned will be equivalent to one class. Please see the Gift Vouchers section for gift voucher refunds.
- Refunds will be available to postnatal Attendees if their baby starts crawling or walking and is no longer deemed safe to participate in class. In this case, if the Attendee has bought a bulk purchase of tickets, the remaining tickets will be refunded.
- Transfers are available to pregnant Attendees who have bought a bulk purchase of tickets should they give birth before they’ve finished their paid-for classes, or if they are hospitalised for a pregnancy related reason, e.g. pregnancy sickness, pre-eclampsia. Any leftover tickets can be used for postnatal yoga classes.
- Transfers are available with a 48 hour notice period. The Attendee must inform POMPOM in writing if they need to transfer their ticket to another session prior to 48 hours before the start of the class in question.
- If an Attendee has bought a ticket or a bulk purchase of tickets and cannot attend a class for a reason not listed above, or does not give prior notice exceeding 48 hours in advance of the class, a transfer will not be available.
- Refunds are not available unless for a reason listed above.
Limitation of Liability
In consideration of POMPOM Women’s Yoga accepting a person as an Attendee, the Attendee agrees that:
- Vehicles, bicycles, buggies and their contents, parked or locked up on or outside any premises used by POMPOM Women’s Yoga, are left at the owner’s risk. POMPOM Women’s Yoga accepts no liability for loss, damage or theft in respect of them, except to the extent that such loss, damage or theft arises from the negligence of POMPOM Women’s Yoga or its employees, agents or sub-contractors.
- Neither POMPOM Women’s Yoga nor its employees or agents shall be liable for any death, personal injury or illness occurring upon any POMPOM Women’s Yoga premises or as a result of the use of the facilities and/or equipment provided by POMPOM Women’s Yoga, except to the extent that such death, personal injury, or illness arises from any negligent act or omission of POMPOM Women’s Yoga or its employees, agents or sub-contractors (Eleanor Flight has Public Liability cover of up to £2 Million and Professional Indemnity of up to £1 Million, a copy of which can be viewed upon request).
Fitness and Health
- Each Attendee agrees to familiarise themselves with what Classes involve prior to assessing whether they are fit to participate in a Class. Attendees should refer to the Bookwhen booking page or should contact Eleanor Flight for further information.
- Each Attendee warrants and represents on the date of their acceptance of these Terms and Conditions and on each occasion that the Attendee attends a class that the Attendee is in good physical condition and that the Attendee knows of no medical or other condition why the Attendee is not capable of engaging in the Classes or exercises provided by POMPOM Women’s Yoga and that such Classes or exercises would not be detrimental to the Attendee’s health, safety or physical condition.
- POMPOM Women’s Yoga staff are not qualified to assess whether the Attendee or any guest is in good physical condition and/or that the Attendee can engage in any exercise without detriment to the Attendee’s health, safety, comfort or physical condition.
- Attendees are advised not to undertake any physical activities without first seeking medical advice if they have concerns over their physical condition. POMPOM Women’s Yoga reserves the right to refuse access to any Attendee if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of POMPOM Women’s Yoga’s facilities.
- Attendees shall not attend POMPOM Women’s Yoga’s classes if they are suffering from infectious or contagious illness, disease or other ailment or suffering from any ailment where there is a risk, however small, that such ailment may be detrimental to the health, safety, comfort or physical condition of the other Attendees. If there is any doubt, Attendees should consult their doctor and must notify POMPOM Women’s Yoga of any circumstances affecting their health, which may be exacerbated through continued use of the Studios.
- Attendees are responsible for informing POMPOM Women’s Yoga staff and teachers of any change to their health that may impact their ability to practise Yoga.
- Menopause classes are designed around common symptoms of perimenopause and menopause. Attendees confirm on booking that they have notified POMPOM Women’s Yoga of any relevant health conditions, in particular osteoporosis or osteopenia, joint or spinal conditions, recent surgery, or any condition affecting balance or mobility, as certain movements may require adaptation.
- Menopause classes are intended to complement, and not to replace, medical care. Nothing taught forms a substitute for advice from an Attendee’s GP or specialist, including in relation to hormone replacement therapy or other treatment.
Pelvic Floor Workshops
- Pelvic floor workshops involve targeted exercise of the pelvic floor muscles. Attendees confirm on booking that they have notified POMPOM Women’s Yoga of any relevant health conditions, including but not limited to prolapse, recent surgery, pregnancy, diastasis recti, or ongoing pelvic health treatment.
- As with any targeted muscle work, Attendees may experience temporary tiredness in these muscles, and some Attendees may experience light leaking during or shortly after the session. This is common and generally settles as strength develops. Attendees may wish to bring a pad.
- Workshops are educational in nature and are not a substitute for medical advice, diagnosis or treatment. Attendees experiencing new, worsening or persistent symptoms should consult their GP or a pelvic health physiotherapist.
Personal belongings, dress, and safety
- Attendees are requested to wear a form of dress appropriate to the practice of Yoga.
- In the interests of safety and hygiene, no crockery, glass, hot drinks or food are permitted in the classrooms. Only water is permitted in the yoga studio (no coloured drinks). No pets (with the exception of guide dogs) owned by Attendees are permitted in the class buildings. Attendees must use the main entrance when entering or leaving the class. Attendees must not interfere with the fire exits.
- In the event of a fire, Attendees should make their way to the nearest available exit.
Mats, props and hygiene
- Shared mats and props are provided for Attendees’ use and are cleaned regularly. Attendees are asked to remove outdoor footwear before stepping onto the mats and to notify Eleanor Flight if any equipment requires attention.
- Attendees are welcome to bring their own mat and props at any time, and are encouraged to do so if they would prefer to use equipment cleaned to their own schedule.
- Accidents can happen, particularly in classes and workshops involving pelvic floor work. Attendees are asked to notify Eleanor Flight at the time of any accident affecting a mat or prop, so that the equipment can be cleaned thoroughly before the next session. Any such notification will be handled discreetly.
General
- Details of Class times may vary from time to time. POMPOM Women’s Yoga reserves the right to change Class times or cancel Classes at its discretion, and will endeavour to give Attendees notice of such changes as is reasonably practicable.
- POMPOM Women’s Yoga reserves the right to refuse admission to classes if the student arrives past the start time for the class.
- Attendees must always observe POMPOM Women’s Yoga’s guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions issued to ensure the safety of the Attendees and the smooth operation of the Studios for the convenience of all Attendees.
- Attendees are required to give written notice to POMPOM Women’s Yoga of any change of email address.
Complaints
Complaints Procedure
In the unlikely event of a student being dissatisfied with any aspect of POMPOM Women’s Yoga, a Complaints Procedure is available. We deal with all grievances as rapidly and efficiently as possible for the benefit of all parties concerned. You can make informal complaints in person to Eleanor Flight. We will aim to resolve your issue within 48 hours wherever possible. We will notify you of the outcome in writing.
Making A Formal Complaint
If you would prefer to make a formal complaint, please write to Eleanor Flight at [email protected]. Complaints received in writing follow a set procedure:
- Firstly, we will acknowledge the complaint within 1 week and, after an investigation, we will arrange a meeting with you.
- Secondly, Eleanor Flight will attend the meeting.
- We will record details of the meeting and will work toward a resolution that is satisfactory for all parties involved.
- We will keep the client informed throughout the complaint’s procedure process.
